1. Acceptance of Terms

By creating an account or using Baby Tracker IL ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Baby Tracker IL. Please read them carefully.

2. Description of Service

Baby Tracker IL is a mobile application that helps parents and caregivers track pregnancy progress and baby development. Features include:

  • Pregnancy week-by-week tracking and contraction timer.
  • Newborn tracking: feeding, sleep, and diaper logs.
  • Growth charts based on WHO standards.
  • Developmental milestone tracking.
  • Vaccination and medical checkup schedules (based on Israeli Ministry of Health guidelines).
  • Tooth eruption map.
  • AI-powered parenting assistant ("Is This Normal?").
  • Multi-caregiver profile sharing.
  • Push notification reminders for feeding, sleep, vaccines, checkups, and milestones.

Features may vary between the free and premium plans, and may be modified, added, or removed at any time with reasonable notice.

3. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account and use this App. The App is intended for use by parents, legal guardians, and authorized caregivers. It is not intended for direct use by children or minors.

By using the App, you represent and warrant that you meet these eligibility requirements and that you have the legal authority to enter data about any child whose profile you create.

4. Account Registration

To use the App, you must create an account with a valid email address. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Providing accurate and up-to-date information.
  • Notifying us immediately if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription Plans & Billing

The App offers two tiers:

Free Plan:

  • Core tracking features with limited functionality.
  • May include non-personalized Google AdMob banner and interstitial ads in selected sections of Android builds where ads are enabled.
  • Limited AI assistant usage (subject to daily message limits).

Premium Plan:

  • All features unlocked, including advanced growth charts, PDF export, and extended AI assistant access.
  • No advertisements.
  • Multi-child profile support.

At present, Premium purchases in the current app are processed through Google Play on Android. Baby Tracker IL does not process card payments directly. Pricing is shown by the applicable store and may vary by region. If we later offer paid subscriptions on iOS, Apple App Store billing terms will apply there.

By subscribing, you authorize the applicable store to charge your selected payment method on a recurring basis until you cancel.

6. Free Trial

If a free trial is offered, it will be clearly indicated at the time of subscription. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial expires. You may cancel at any time during the trial at no cost through your device's subscription settings.

7. Cancellation Policy

You may cancel your Premium subscription at any time through the store used for the purchase.

  • Android (currently supported): Google Play Store > Subscriptions > Baby Tracker IL > Cancel.
  • iOS: If iOS subscriptions are offered in the future, cancellation will be handled through Apple subscription settings.

Upon cancellation:

  • Your Premium access remains active until the end of the current billing period.
  • No prorated refunds are issued for unused portions of a billing period.
  • After expiration, your account reverts to the Free Plan.
  • Your data is preserved and remains accessible under Free Plan limitations.

8. Refund Policy

Refunds are handled by the payment platform used for the purchase.

Baby Tracker IL does not process refunds directly and cannot issue store refunds outside the relevant store mechanisms.

9. AI Assistant — Medical Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

The App includes an AI-powered feature called "Is This Normal?" that provides general informational responses about pregnancy and baby development. This feature is powered by Google Gemini AI.

THIS FEATURE IS NOT A MEDICAL SERVICE. Specifically:

  • The AI assistant does NOT provide medical advice, diagnosis, or treatment recommendations.
  • It does NOT replace consultation with a qualified pediatrician, obstetrician, gynecologist, midwife, or any other healthcare professional.
  • Responses are generated by artificial intelligence and may contain inaccuracies, outdated information, or information that does not apply to your specific situation.
  • You must NEVER use AI responses as the sole basis for medical decisions regarding your health or your child's health.
  • In any medical emergency, contact your local emergency services (e.g., Magen David Adom at 101 in Israel, 911 in the US, 112 in Europe) or go to the nearest emergency room immediately.

By using the AI assistant, you acknowledge and agree that:

  • You use this feature entirely at your own risk.
  • Baby Tracker IL, its developers, and its affiliates bear no responsibility for any actions taken or decisions made based on AI-generated responses.
  • You will always consult a qualified healthcare professional for medical concerns.

10. User Content & Data

You retain ownership of all data you enter into the App (child profiles, health records, milestones, photos, etc.). You are solely responsible for the accuracy and legality of the data you provide.

By using the App, you grant Baby Tracker IL a limited license to process your data solely for the purpose of providing the App's services, as described in our Privacy Policy.

For detailed information about how we collect, use, store, and protect your data, please refer to our Privacy Policy, available within the App.

11. Prohibited Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to the App, other users' accounts, or our servers and systems.
  • Reverse-engineer, decompile, or disassemble the App or its components.
  • Use automated systems (bots, scrapers, crawlers) to access or collect data from the App.
  • Transmit viruses, malware, or any harmful code.
  • Impersonate another person or entity.
  • Use the App to harass, abuse, or harm others.

Violation of these terms may result in immediate account suspension or termination.

12. Intellectual Property

The App, including its design, code, features, content, trademarks, and logos, is the intellectual property of Baby Tracker IL and is protected by applicable copyright, trademark, and intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works based on the App or its content without prior written permission.

User-generated content (your data, photos, notes) remains your property, subject to the limited license granted in Section 10.

13. Limitation of Liability & Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Baby Tracker IL does not warrant that:

  • The App will be available at all times or without interruption.
  • The App will be free of errors, bugs, or security vulnerabilities.
  • The information provided by the App (including AI responses, growth percentiles, and medical schedules) will be accurate, complete, or current.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Baby Tracker IL and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law.

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we will try to notify you via in-app notification or email before the changes take effect where appropriate.

Your continued use of the App after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the App and delete your account.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Israel. Any disputes arising from or related to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts in Tel Aviv-Jaffa, Israel.

For users in the European Union: Nothing in these Terms limits your rights under applicable EU consumer protection laws. You retain the right to bring claims before the courts in your country of residence.
